I hereby authorize the foregoing information to be published in the FRAMCO membership directory, and to be disseminated and used in accordance with FRAMCO policies, as such policies may be established and changed by the Board of Directors of FRAMCO from time to time. Upon request, FRAMCO will provide me with a copy of their current policy. I further acknowledge that, as a FRAMCO member, I will have access to FRAMCO membership information, through the FRAMCO membership directory and otherwise. I agree that, without regard to my membership status, I shall not make excessive or otherwise inappropriate use of such information for unsolicited commercial communications, such as by telephone, facsimile, and e-mail. I agree that the FRAMCO Board of Directors has the right to determine, in its sole discretion, that excessive or inappropriate use has occurred and upon such determination terminate or suspend my right to use FRAMCO membership information. I further agree that FRAMCO, or any party to which FRAMCO may assign such right, may enforce these rights by injunction in any court of competent jurisdiction, and that the prevailing party in any such proceeding may recover reasonable attorney’s fees and costs.
It shall be the general policy of FRAMCO that access to membership information, primarily through the FRAMCO membership directory but also as it may otherwise be available, shall be one of the primary benefits of FRAMCO membership, and as such, as a general rule, such information shall only be available to FRAMCO members.
The FRAMCO Board may make FRAMCO membership information available to third parties when in its sole discretion the Board determines that doing so would serve to benefit the membership at large or materially advance one or more interests or goals of FRAMCO as an organization.
FRAMCO members are expected to use FRAMCO membership information responsibly and appropriately. The FRAMCO Board recognizes that FRAMCO is essentially a business organization. Accordingly, the FRAMCO Board recognizes that the use of FRAMCO membership information for business and commercial purposes is generally consistent with the purpose and goals of FRAMCO and FRAMCO membership. However, the FRAMCO Board is also aware of the burden of unsolicited commercial communications, and accordingly has reserved to itself: 1) the right to determine when and whether an excessive or otherwise inappropriate use of FRAMCO membership information has occurred, 2) the right, in such instances, to suspend or terminate a person’s right to use such information, and 3) the right to enforce the foregoing rights by legal action. In general, the FRAMCO Board discourages automated, mass communications to all or a substantial portion of the membership by fax or e-mail, and will be strongly inclined to view such actions as excessive or inappropriate.
